SC upheld the death sentence of Ajmal Amir Kasab and rejected his appeal

The Supreme Court today upheld the death sentence awarded to 26/11 gunman Mohammed Ajmal Amir Kasab and rejected his appeal against his conviction and death sentence in the 26/11 Mumbai terror attacks in which 166 people were killed.

“We are left with no option but to uphold the death sentence of Kasab,” the Supreme Court bench observed.



Waging war against the country is the primary and foremost offence committed by Kasab, the court observed.

25-year-old Kasab had filed the appeal from jail, challenging his conviction and death sentence. The apex court had appointed senior advocate Raju Ramachandran as amicus curiae to argue on behalf of Kasab.

A bench of justices Aftab Alam and CK Prasad had reserved its verdict on 25 April after a marathon hearing, spanning over two and a half months, of arguments by the prosecution and defence counsel in the terror mayhem, which involved random firing by Kasab and other mercenaries.

SC seeks service record of Lt Gen Bikram Singh

The Supreme Court today directed the Centre to place before it the file pertaining to the appointment of Lt Gen Bikram Singh as the next Army Chief.

A bench of justices R M Lodha and H L Gokhale decided to go through the confidential document while hearing a PIL challenging the appointment of Bikram Singh and asked the government to place the file before it at 2 PM.

Right to Education implements today by SC

To cover the chasm between the education of poors and affluent class, the poor sectoin would now be taken into consideration equally after the implementation of Right to Education today by the supreme court of India.

Reilef for the impovershed and to give equal opportunities to them, right to education has been implemented to promote literacy among all irrespective of any sectarian basis.

All the schools are now under the umbrella of RTE, under 14 would be provided free of cost education.

SC grants bail to Pakistani scientist Dr Chishti

Pakistani virologist Khalil Chishty in connection with a murder case. The octogenarian was lodged at the Ajmer Central Jail for years.

Meanwhile, the apex court has also agreed to hear his plea to return to Karachi and has asked his lawyers to file a separate petition for this.

An apex court bench headed by Justice P. Sathasivam granted bail to the virologist, subject to conditions to be imposed by the trial court.




Senior counsel U.U. Lalit, who appeared for Chisty, told the court that his client could not move out of Ajmer as his visa was limited to the holy city.

Dr Chishty, who is accused of killing a man during a brawl in Ajmer in April 1992, was on a visit to the city then to offer prayers at the shrine of Sufi saint Hazrat Khwaja Moinuddin Chisty.

The Karachi virologist was awarded life imprisonment after an 18-year-long trial. Chisty, a heart patient for three decades, is unable to walk unaided and has to be carried to and from the jail by two people.

According to reports, in the lunch meeting between Prime Minister Manmohan Singh and Pakistan President Asif Ali Zardari on Sunday, during the latter's one-day India visit, had also dicussed Dr Chishty's case. Pakistani officials have urged India to set Dr Chishty free, the sources added.

Justice Markandeya Katju had in June last year requested Prime Minister Manmohan Singh to release Dr Chisty on humanitarian grounds.

Acting on Justice Katju's appeal, Rajasthan Chief Minister Ashok Gehlot approved his mercy plea and sent it to Governor Shivraj Patil for final clearance. But Patil sent a questionnaire to the law department on various issues related to the case.

SC dismisses PIL on Army chief's age row

The Supreme Court will today hear a PIL seeking a direction to the government to declare May 10, 1951 as the date of birth of Army Chief Gen VK Singh instead of May 10, 1950. However, the petition filed by Gen Singh himself on the issue may not not come up for hearing as it is neither listed in the list of business nor in the list of matters to be mentioned on Monday.

Singh`s counsel Punit Bali said he has no instructions as of now for mentioning the petition filed by Army Chief when the bench will take up the matter of The Grenadiers Association.

The PIL, filed by The Grenadiers Association (Rohtak Chapter), is listed for hearing before a three-judge bench headed by Chief Justice S H Kapadia on which the Ministry of Defence has already filed a caveat that no order should be passed without hearing it. In the PIL it has been submitted that it was forced to approach the court as both Prime Minister Manmohan Singh and Defence Minister AK Antony had rejected Singh`s plea for change of his date of birth.

Earlier on December 16, the NGO`s petition could not be heard by the bench of justices B S Chauhan and TS Thakur as the Justice Thakur had refused to hear it.

The petitioner, an NGO headed by retired colonel BS Koshal, claimed the uncertainty over Army chief`s date of birth has affected his morale impinging on national security. The petition had sought a direction to the government to declare May 10, 1951 as the date of birth of Singh instead of 1950.
